Anyprices is not an agent of any seller or a sale agent of any provider of products and services. Anyprices is free from any liability or responsibility related to any product or services listed on the Websites. Other than products bought by a merchant from anyprices store, in case of any questions, complaints or claims regarding any product or service, you should channel them to the appropriate seller or provider. Anyprices does not offer endorsements neither does it warrant or guarantee the products or the services of any seller, broker or lender.

Anyprices does not offer guarantee or warrantees in any way relating to the shipping costs, prices, taxes, product descriptions, or any other content in the Websites is accurate, reliable, complete, current or free of errors. Anyprices will not be liable for any incompleteness or inaccuracy in the content of a product or a service, the ratings of the user or the commentary, or other content in the Website because the content in the Website is provided for informational purposes alone. Should there be any discrepancy between information in the Websites and information found in the merchant site, then the information found in the merchant site shall take precedence over the information on the Websites.

In lieu of the offering with reference education that are advertised on the Websites, Anyprices offer no assistance in any kind of application, has no control and does not offer any guarantees of admission of any nature, or the availability or eligibility for any kind of financial aid or any other type of funding.

Anyprices will not be held responsible for any delays, inaccuracy, error or omissions regarding the information or the relay o the delivery of all or any part thereof, of any damages arising from or caused by or the results obtained as a result of the use of such information. Anyprices is free from liability from any act or omissions of any merchant or service provider on the Website. It is your responsibility to assume any risk that may be associated with the adequacy, accuracy, completeness, currency, quality and the validity of information regarding the Services.

Anyprices has the discretion to alter, modify, amend, update or make changes in any form to the information displayed on the Websites without giving any notice for any reason including but not limited to making the information compliant with the existing policies.

There are certain merchants or service providers who opt to carry out their transactions via their own store or their own applications. When dealing with such merchants or service providers, you will be redirected to their websites or they will contact you. Any dealings, applications or interaction that will take place between you and the merchants or the service providers on or through the service providers’ or merchants’ websites offline store or any other application processes will be guided by the conditions or agreements made between you and the merchants or service providers.

In some instances we will make it possible for merchants to create online stores to advertise their merchandise. These stores are referred to as “Anyprices stores”. For merchants that use Anyprices Stores, we will provide them with payment processing services but all sales are made by the merchant. If you decide to complete such transactions, then you acknowledge and accept that Anyprices shall not determine the terms, policies or any other agreement relating to the use of store processing services and you accept to be bound by such terms, policies and agreements. Anyprices does not have any obligation or liability with respect to store processing services unless otherwise agreed in to writing by anyprices.

In all the cases, transaction is between you and the merchant or service provider. Anyprices or its co-branded partners, licensees or affiliates (collectively, “Partners”) will not be liable or have any obligations or responsibilities relating to any transactions that happens between you and the users of the Website.

You acknowledge and accept that this Agreement and any terms of service or other policies established by third parties shall govern all transactions in which you participate in through the service by participating in any transaction which involves or results from the use of the Service.

We may offer provisions to merchants to create Anyprices stores. Even though we provide Stores Processing Services to merchants who use Anyprice Stores, all sales are made by the merchant. As a buyer of products or services from Anyprices stores you acknowledge and agree that:

1. You give permission to Anyprices to process payment transactions as you shall direct and to pass on any payment transaction information or shipping or other type of information that you shall provide to the merchant from whom you make the orders from. In addition, you give consent that adjustments or reversals can be made to your payment method (e.g. debit card, credit card or any other means of payment accepted by Anyprices. ) in cases of returns, reversals, cancellations, refunds, chargeback or any other type of payment adjustments.
2. Each merchant will post their return policies and other relevant policies in the Anyprices stores and your transactions shall be guided by such policies. To find out more about Anyprices Stores Policies, click here.
3. Anyprices has the discretion to cancel any order if the merchant notifies Anyprices that the product is out of stock, in the event that the merchant fails to confirm the receipt of the order or shipment within the specified times, or the merchants fail to comply with Anyprices’s requirements. Anyprices has no liability with regards to any order it cancels except to return any payment you may have made for the cancelled order.
4. If you receive a product whose information or description in not accurate, you only cause of action is to return the product to the merchant as per their return policy.
5. Even though Anyprices might provide the Stores Processing Services to you in relation to the purchases you make via the Anyprices Stores, note that Anyprices is not a party to any of the transactions between and the various merchants or service providers from whom you obtain the products or services from. Anyprices shall therefore not take any liability or responsibility regarding any part of your transactions or any disputes or disagreements that may arise either directly or indirectly as a result of your transactions.
6. Anyprices does not offer any guarantees with regards to the identity of any merchant and does not control or give assurance in any way with regards to the legality, accuracy, truth, or quality of the products or the information about the products as listed in the Anyprices Stores. Anyprices hereby revokes all warranties, representations, and terms and conditions that may relate in any way to any product listed in any Anyprices Store, whether express or implied, including, but not limited to, the implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. Anyprices does not endorse any merchant.
7. Anyprices and its subsidiaries, partners, affiliates and service providers will be indemnified against all claims that may relate to any transaction that takes place between you and any merchants or other users or the Anyprices stores.
8. Anyprices will not take any responsibilities or liabilities for any harm or damage that may result or arise from, or any misuse of your personal information to the extent that you complete a transaction through the use of a Transaction Processor.
9. Anyprices has no control over the business practices of the merchants and you agree to notify Anyprices at storessupport@anyprices.com in the event that you suspect that a merchant is engaged in fraudulent, misleading or deceptive activities.
10. When you make any purchase from the Anprices Stores, the purchase shall be governed by this Agreement including any other terms of use, policies other agreements that the merchant may have posted in the Anyprices Stores.
11. Anyprices has the sole discretion at anytime to terminate your ability to use or purchase products at Anyprices Stores.
12. You may have the ability to access certain feature of the Anyprices Stores via certain mobile carriers (the “Mobile Service”). Whereas Anyprices does not demand any charges from the mobile services, your carrier’s normal rates may be applicable. When you use the mobile service, you give permission that certain information about how you use your mobile carrier may be relayed to Anyprices.
13. Anyprices has no responsibility or obligations whatsoever, for the processing, fulfillment or any other costs that may be associated with the products which you purchase at an Anyprices Store.

Anyprices and its Partners may provide certain links to external website or resources that are not necessarily related to Anyprices for the purposes of your convenience and reference only. Anyprices and its Partners has no control neither to they have responsibility over the availability of or your experience on these external websites or resources or for the content, adverts, products, or other materials which may be available in such websites. You use information or deal with the owners of these external websites at your own risk. The moment you click on the external websites and you are redirected, you understand that you should read and understand the terms and conditions and the relevant policies that govern your use while you are on that external website. Anyprices and its partners will not be held responsible for any claims arising from your use of the external websites or resources.

In order to you to access certain functions of the Websites, registration as a member is mandatory. When you register as a member or when you update your registration data, you must provide current, complete and accurate information about yourself (The “Registration Data”). You agree that you will not misrepresent your identity. If your Anyprice account has been suspended then you may not be able to use the Websites and Services. You agree to keep your Registration Data current and make updates whenever there are any changes. It is your responsibility to maintain the security of your password and Anyprice and its partners will not be liable for any losses you suffer as a result of the loss of your password or the use of your password with others. You accept to notify Anyprices of any unauthorized access to your account or any security breach that you may notice in your account with regards to the Services. You agree to report the violation of this agreement by others to buyersupport@anyprices.com.

Anyprices reserves the ownership of all material included on the Websites or Services including but not limited to texts, graphics, trademarks, logos, service marks and copyrights (The “content”). All the content is the property of Anyprices and other parties. All the content available in the Websites are protect by U.S and other international laws. Contents displayed on the Websites can be downloaded strictly for personal non commercial use so long as you retain the copyrights as well as other propriety notices contained in the content. It is a criminal act to use, modify, copy, distribute, transmit, display, publish, sell, license or create any kind of works using any of the content either for commercial or public purposes.

1. Grant of license: You hereby grant to Anyprices on all media provided by you to Anyprices that are not marked as confidential (“Members Content”) such as seller and producer reviews and display your name or username , trademarks as well as service marks ( as used with regards to member content). You are only allowed to submit member content only in compliance with Anyprices’s current content submission guidelines. Anyprices is not obligated to post Members content, and may pull down member content submitted by you or others in reference to the Websites. All Member Content submissions are to be made through https://www.anyprices.com until or unless Anyprices specifies another form of delivering member content. Anyprices will consider posting Member content on the website as the sole consideration of the right and license granted to Anyprices in this agreement. Though not required, Anyprices may edit or modify any member content as it deems appropriate in order to comply with Anyprice policies.
2. Ownerships, Copyrights and Trademarks: Subject to the license granted herein, you shall retain all rights, title and interests in and to Member content you submit to Anyprice and you shall represent and offer warranties that such member content and the license granted herein are

   3. Does not contain any information which is obscene or defames, libels or which may cause injury or may interfere with the privacy of others.
   4. Does not require payment of any kind by Anyprices or others.

Your use of the service must be lawful and has to be consistent with the security and reliability of the services and the World Wide Web. Other than this, the following apply to your use of the Service:

1. You certify that you are 18 year old or above and that you are able to get into legally binding contracts.
2. You assume full responsibility of the use of the service by a minor.
3. You use the service as per the applicable local, national and international laws and regulations, procedures and policies.
4. The content of your submission is your sole responsibility. You acknowledge and agree that Anyprices offers no endorsements to the actions, contents of communications, or products of any user, merchant or service provider.
5. It is your responsibility to obtain any equipment or ancillary needed to make connection and gain access of the service. This includes but not limited to modems, software, hardware, and telephone services. It is also your responsibility to ensure that such equipment and the ancillary services are compatible with the Service.
6. It is a must that you complete all transactions you agree to complete with regards to the service.
7. You must obey all the then current terms of Anyprices’ Privacy Policy as laid on the website and as updated from time to time at the discretion of Anyprices.

You must not:

1. The service must never be used for any illegal purposes or for transmitting any material that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene, tortious, or otherwise objectionable, or that infringes or may infringe the intellectual property or other rights of another, including the sale of pornography, firearms and ammunition, living creatures and parts of endangered species, stocks and other securities, drugs and drug paraphernalia, human body parts and remains.

4. Conduct fraud, hide or attempt to hide your identity, represent yourself as someone else, or manipulate or attempt to manipulate prices, compromise or attempt to compromise the security of any account, interfere or attempt to interfere with the proper working of the Service.
5. Directly or indirectly tamper with or attempt to tamper with the proper functioning of any of the Websites, any account, or any communication or transaction being conducted on our Websites.
6. Use the Services for any use other than personal, non-commercial purposes unless specifically approved in writing by Anyprice, in its sole discretion.

You and other users have the permission to post content or review the content posted by other users in the Websites. Anyprices is under not obligated in any way to monitor such content and has no responsibility neither does it endorse any such content posted by the users.

You are free to submit reviews to describe your shopping experience and your experience with the merchants or service providers but as you do so:

1. You consent that you will not submit any reviews in bad faith about a merchant or a service provider whom you have obtained goods and services or you have attempted to obtain goods and services. In your review, you must provide an accurate representation of the experience you had with a particular merchant or service provider.
2. Any review that you shall submit shall be subject to terms and conditions as well are restrictions described elsewhere in this Agreement and also to Anyprices’s policy with regards to user content and reviews.
3. Anyprices have the powers to edit any reviews that might be displayed on the website without giving any prior notice to the owner of the review so as to ensure compliance with the existing policies.
4. Merchants and service providers have the rights to dispute the validity of a review and Anyprices has the legal mandate to remove the review or take any action that it will deem necessary under the circumstances.
5. Reviews are submitted by other users and as such, Anyprices can’t control the content or the accuracy of any reviews.

You consent to indemnify Anyprces and its partners, officers, employees, and service provider from any claims that may be made by any third party coming up as a result of:

1. How you use the Service or the content present therein
2. Your violation of this Agreement
3. Your infringement or the other users of the service with your computer or any intellectual property of anyone or entity.

NOTHING IN THESE TERMS OF USE SHALL AFFECT THE STATUTORY RIGHTS YOU ARE ENTITLED TO AS A CONSUMER TO THE EXTENT THAT SUCH RIGHTS CANNOT BE WAIVED OR ALTERED BY YOUR CONTRACTUAL AGREEMENT. YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR OWN RISK. ANYPRICES PROVDIES THE SERVICE ON AN "AS IS" BASIS. ANYPRICES AND ITS SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, TERMS AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED (WHETHER BY STATUTE OR OTHERWISE), INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ANYPRICES AND ITS SERVICE PROVIDERS MAKE NO REPRESENTATION, WARRANTY, OR TERM OR OTHER CONDITION (i)THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; (ii) AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, CONFIDENTIALITY OR PRIVACY OF ANY OF USER'S INFORMATION REGISTRATION DATA, OR ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE. ANY MATERIAL OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DATA. ANYPRICES AND ITS SERVICE PROVIDERS MAKE NO REPRESENTATION, WARRANTY, TERM OR CONDITION REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE AND ARE NOT RESPONSIBLE FOR ANY USE OF CONFIDENTIAL OR PRIVATE INFORMATION BY SELLERS OR OTHER USERS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM ANYPRICES OR THROUGH THE SERVICE, SHALL CREATE ANY REPRESENTATION, WARRANTY, TERM OR CONDITION NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

WHILE ANYPRICES TAKES REASONABLE STEPS TO SAFEGUARD AND TO PREVENT UNAUTHORIZED ACCESS TO YOUR INFORMATION AND REGISTRATION DATA, WE CANNOT BE RESPONSIBLE FOR THE ACTS OF THOSE WHO GAIN UNAUTHORIZED ACCESS, AND WE MAKE NO REPRESENTATION, WARRANTY, TERM, OR CONDITION, EXPRESS, IMPLIED OR OTHERWISE, THAT WE WILL PREVENT UNAUTHORIZED ACCESS TO YOUR PRIVATE INFORMATION. IN NO EVENT SHALL ANYPRICES BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY'S UNAUTHORIZED ACCESS TO YOUR INFORMATION OR REGISTRATION DATA, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER ANYPRICES WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.

ANYPRICES AND ITS SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM THE USE OF OR INABILITY TO USE THE SERVICE, ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE, OR UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF ANYPRICES OR ITS SERVICE PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL ANYPRICES AND ITS SERVICE PROVIDERS EVER BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, AND COSTS, WHETHER IN CONTRACT, TORT OR UNDER OTHER FAULT OR WRONGDOING BY ANYPRICES OR ITS SERVICE PROVIDERS OR ANY PERSON FOR WHOM EITHER ANYPRICES OR ITS SERVICE PROVIDERS ARE RESPONSIBLE, IN AN AMOUNT EXCEEDING THE AMOUNT YOU PAID TO ANYPRICES FOR THE USE OF THE SERVICE WHICH IS THE SUBJECT OF THE CLAIM.

Anyprices, ITS SUBSIDIARIES AND AFFILIATES, ITS SERVICE PROVIDERS AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, INFORMATION PROVIDERS, SERVICE PROVIDERS, SUPPLIERS, LICENSORS AND LICENSEES, AND ALL OTHER RELATED, ASSOCIATED, OR CONNECTED PERSONS FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE AND KIND WHATSOEVER AND HOWSOEVER ARISING, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER EXIST, WHICH ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE SERVICE. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor," as well as any other statute or common law principle of similar effect.

You may be blocked from using the Service should you breach any provisions of this Agreement. Anyprices has the discretion to change, suspend, and to terminate either temporarily or permanently the Service or any part at any time without giving out any prior notice and without being liable to you or any other person in any way. This agreement will continue to apply and bind you due to your prior use of it should Anyprices decide to terminate this Agreement for whatever reasons. Anyprice may remove the Websites as well and the content posted by you or other users without any prior notice or without being liable to you or other users in the event that this Agreement is terminated. Anyprices may also destroy any content or material submitted by you or other users of the Websites upon termination.

Disputes between you and Anyprices shall be resolved by arbitration. The arbitration shall be held before an arbitrator not as class arbitration but on an individual basis. You agree to waive any right you may to arbitrate a dispute as a class. The following organizations may be selected for arbitration together with their applicable rules; American Arbitration Association and the National Arbitration Forum. A copy of the arbitration rules of each of the organizations can be obtained by contacting them.

The arbitrators shall be selected according to the relevant rules and regulations and they shall be attorneys or retired judges. The arbitrator to conduct the arbitration shall be agreed upon by you and Anyprices. The arbitrator shall use governing substantive laws while making awards. During the arbitrations, Anyprices will pay for filing, service, administration, and case management fees including other cost that may be incurred on the first day of arbitration. The other costs will be paid by the other non-prevailing party. Each party will be responsible for the attorney fees and other fees stated otherwise by the arbitrator under the applicable laws.

THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND ANYPRICE WILL BE RESOLVED BY BINDING ARBITRATION AND NOT IN COURT OR BY JURY TRIAL. IF A DISPUTE IS ARBITRATED, YOU GIVE UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST ANYPRICE INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS. WITHOUT LIMITATION, THIS INCLUDES GIVING UP YOUR RIGHTS TO BRING OR PARTICIPATE IN A CLASS ACTION AS SET FORTH IN THE WISCONSIN CONSUMER ACT, WIS. STATS. 426.110.

The Websites are but venues which allow merchants and service provider to post products and services which may be of interests to users. It also gives users the ability to provide information and feedback regarding their experiences with the merchants or service providers. If you have reasons to believe that a user or a merchant or a service provider have used the website in a manner that infringes on your personal rights, then Anyprices strongly urges you to resolve the dispute directly with the users, merchant or service provider. Anyprice have not control and does not have any responsibility for content, product or services offered by third party websites and that can be accessed through the Websites. In case of such violations, contact the third party directly.

In order to give a notice of trademark or copyright infringement, do avail the following information to Anyprices’s copyright agent:

A description of the trademark, copyright or intellectual property that you claim has been violated.

The location on the Website of the item which you claim to have been infringed.

A statement by you indicating that you have good faith and that the disputed use is not authorized.

A statement by you made under a penalty of perjury that the above information is accurate to the best of your knowledge and that you are the owner of the copyrighted material or that you have been authorized by the owner of the trademark, copyright or the intellectual property to act on his behalf. Unless stated otherwise, all notices shall be given in postal mail to Anyprices Inc.

Our services are provided online and our interactions with you will also be online. You agree to receive communications from us electronically. Our communication to you will be through emails or by posting notices in the Websites. You agree that all communications transmitted to you electronically meet any legal requirements.

This Agreement contains the entire agreement between you and Anyprices and it supersedes all other prior agreements with regards to the subject matter contained herein. Anyprices may make amendments to this Agreement from time to time. Should you continue to use the Services after the amendments have become effective then you shall be deemed to have consented to the new amendments. If you choose not to agree to the amended terms, then you automatically disqualify yourself from using the Services. Your continued use of the service affirms that you have acknowledged this agreement and its amended terms, and that you agree to abide and be bound by the agreement and its amended terms.

A printed version of this agreement and of any other notices shall be admissible in a judicial or any other administrative proceedings relating to this agreement.
